These Terms of Service (“Terms”) govern your use of the VengaDragon Substack publication (the “Publication”), written and managed by Mark (“Mark” or “we,” “us,” or “our”). By accessing, reading, or subscribing to the Publication, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Publication.
1. Acceptance of Terms If you are under 18, I prefer that you don’t follow the publication, however, you represent that you have reviewed these Terms with your parent or legal guardian and that they agree to these Terms on your behalf. Your use of the Publication is also subject to Substack’s own Terms of Use.
2. Purpose of the Publication The VengaDragon Publication serves as a newsletter containing content created by Mark. The Publication contains information, commentary, recommendations, links, and other content (collectively, “Content”) related to Mark’s interests and projects.
3. Intellectual Property a. Content Ownership: All original Content created by Mark and published on the Publication, including text, graphics, logos, and images, is the property of Mark and is protected by copyright and other intellectual property laws. b. Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and read the Content for personal, non-commercial purposes only.
4. User Conduct You agree not to use the Publication to: a. Violate any applicable laws or regulations. b. Infringe upon the rights of others, including intellectual property rights. c. Post comments or engage in conduct that is harmful, harassing, defamatory, or otherwise objectionable. d. Introduce viruses or any other malicious or technologically harmful material. e. Violate Substack’s Terms of Use or Community Guidelines.
5. Links to Third-Party Websites The Publication contains links to external websites, social media platforms, and content owned and operated by third parties (including Mark’s other projects). These links are provided for your convenience. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. Your access and use of any linked website are at your own risk.
6. Privacy Your use of the Substack platform is governed by Substack’s Privacy Policy, which details how they collect and use your data. When you subscribe to the Publication, you provide your email address to us through the Substack platform. We will only use this information to deliver the newsletter and communicate with you as a subscriber via the Substack service.
7. Disclaimer of Warranties The Publication and all Content are provided on an “as-is” and “as available” basis, without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Publication or the underlying Substack platform will be uninterrupted, error-free, or secure.
8. Limitation of Liability To the fullest extent permitted by law, Mark shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Publication; (b) any conduct or content of any third party within the Publication (such as in comments); or (c) unauthorized access, use, or alteration of your subscriber information.
9. Governing Law These Terms shall be governed and construed in accordance with the laws of Maryland, USA, without regard to its conflict of law provisions.
10. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms within the Publication. Your continued use of the Publication after any such changes constitutes your acceptance of the new Terms.
